Abstract:
Purpose. To investigate the state of implementation of the right of employees (RE) to decent, safe and healthy working conditions (DSHWC), to identify factors of inadequate provision of guarantees of this right. To determine the impact of the level of enforcement of this right on other social and economic areas of activity. To identify gaps in the legal framework in this area and propose recommendations for changing legal norms to address them.
Methodology. The study uses general scientific and special legal methods. The formal and legal method allowed proposing an improvement of risk-oriented method aimed at taking into account and predicting the pace of threats, changes in their number, magnitude and directions of influence. The method of legal hermeneutics allowed identifying gaps in the regulatory and legal field in ensuring RE to DSHWC and offering recommendations on changing legal norms to eliminate them.
Findings. The factors that determine the inadequate provision of guarantees RE to DSHWC were identified. It is indicated that military hazards and industrial risks can mutually reinforce threats to working conditions. It is proposed to standardize the systematic combination of measures focused on DSHWC and civil security measures. A new mechanism is proposed for insurance coverage of workers by introducing individual contracts, which will increase both the level of monitoring and control of safety at work and the level of social responsibility of employers.
Originality. It is proposed to improve the risk-oriented method aimed at taking into account and predicting the pace of threats, changes in their number, magnitude and directions of influence in real time. An approach is proposed to taking into account the prolonged action of the harmful effects of working environment factors on the health of workers. The concept of a production micro-ecosystem of healthy work is proposed.
Practical value. The developed recommendations for improving legal norms and eliminating shortcomings in the legal field regarding the issues of ensuring the right of employees to DSHWC will contribute to the legal regulation of occupational safety and health.
